Entrato in vigore l’Accordo sullo scambio di informazioni in materia fiscale con il Brasile

L’Accordo tra la Svizzera e il Brasile sullo scambio di informazioni in materia fiscale è entrato in vigore il 4 gennaio 2019. Le sue disposizioni si applicheranno dal 1° gennaio 2020.

L’Accordo sullo scambio di informazioni in materia fiscale («Tax Information Exchange Agreement», TIEA) disciplina lo scambio di informazioni in materia fiscale su domanda. Si tratta del decimo TIEA posto in vigore dalla Svizzera. Le disposizioni dell’Accordo si applicheranno alle domande di informazioni riferite agli anni fiscali che iniziano il 1° gennaio 2020, o dopo tale data.

Entrambi i Paesi intendono rafforzare ulteriormente la cooperazione in materia fiscale con una Convenzione per evitare le doppie imposizioni (CDI). La CDI è stata firmata e si trova ora al vaglio del Parlamento.

Exchange of information agreement between Brazil and Switzerland enters into force    

4 January 2019, Switzerland and Brazil ratified the “Tax Information Exchange Agreement (TIEA)”. This agreement authorizes the two countries to exchange information on a specific request coming from the tax authorities of the respective signatories countries.

The Parliaments of the two countries involved already gave the authorization for the signature in 2016 with the scope to delete the Switzerland from the Brazilian black list and give more economic and legal certainty to the investments.

This signature represent also an important step forward for the ratification of the double tax treaty between the two countries that is pending since 2018.

Based on the TIEA, the two countries starting from 2020 will exchange tax information on request.

Acordo de troca de informações entre Brasil e Suíça entra em vigor

Em 04 de janeiro de 2019, Suíça e Brasil ratificaram o Acordo de Troca de Informações Fiscais (“Tax Information Exchange Agreement  – TIEA”). Esse acordo autoriza a troca de informações sobre questionamentos específicos formulados por autoridades fiscais dos respectivos países signatários.

Os Parlamentos dos dois países envolvidos já autorizaram a assinatura em 2016 com o objetivo de excluir a Suíça da lista negra brasileira e dar mais segurança econômica e legal aos investimentos.

Essa assinatura representa também um passo importante para a ratificação do tratado de dupla tributação que está pendente desde 2018.

Com base no TIEA, os dois países trocarão informações fiscais mediante solicitação a partir de 2020.
